Environmental Rules Review Committee

Public Act 267 of 2018 created the Environmental Rules Review Committee (ERRC) to oversee the rulemaking of the Michigan Department of Environment, Great Lakes, and Energy. The ERRC is comprised of four ex-officio department heads and 12 members, appointed by the governor, who represent different industries and organizations outlined in statute.

Current Rulemaking

  • On February 13, 2023, the Michigan Office of Administrative Hearings and Rules (MOAHR) approved EGLE's Request for Rulemaking (RFR) for 2023-13 EQ and sent the RFR to the Joint Committee on Administrative Rules (JCAR) and the ERRC. 

    On February 1, 2024, the 2023-13 EQ Draft Rules and Regulatory Impact Statement (RIS) were sent to MOAHR and the ERRC. A quorum could not be established to review the draft rules and RIS within 35 days of receipt. EGLE will proceed to a public hearing on the draft rules per MCL 24.266(7)(d).

     

  • On January 17, 2023, the Michigan Office of Administrative Hearings and Rules (MOAHR) approved EGLE's Request for Rulemaking (RFR) for 2023-5 EQ and sent the RFR to the Joint Committee on Administrative Rules (JCAR) and the ERRC.

    The ERRC’s Chair and Vice-Chair determined the ERRC should have no further oversight of the ruleset and the ERRC agreed.

  • On February 10, 2023, the Michigan Office of Administrative Hearings and Rules (MOAHR) approved EGLE's Request for Rulemaking (RFR) for 2023-11 EQ and sent the RFR to the Joint Committee on Administrative Rules (JCAR) and the ERRC.

    The ERRC’s Chair and Vice-Chair determined the ERRC should have no further oversight of the ruleset and the ERRC agreed.

  • On February 15, 2023, the Michigan Office of Administrative Hearings and Rules (MOAHR) approved EGLE's Request for Rulemaking (RFR) for 2023-14 EQ and sent the RFR to the Joint Committee on Administrative Rules (JCAR) and the ERRC.

    The ERRC’s Chair and Vice-Chair determined the ERRC should have no further oversight of the ruleset and the ERRC agreed.

  • On May 8, 2024, the Request for Rulemaking was withdrawn to review and potentially revise the scope of the proposed rules.

  • Drinking Water and Environmental Health Division’s rules were filed with the Office of the Great Seal and effective May 26, 2023.

  • Air Quality Division's Part 9 rules were filed with the Office of the Great Seal and effective November 4, 2021.

    This rule set did not go through the oversight of the ERRC. On November 5, 2020, the ERRC's Chair and Vice-Chair held a public meeting to discuss the RFR for 2020-60 EQ. The Chair and Vice-Chair voted the ERRC should have no further oversight of the ruleset and the ERRC agreed.

    This rule set did not go through the oversight of the ERRC because the rulemaking started prior to the creation of the ERRC.
