Purchased content is exclusively for the customer’s individual, personal, noncommercial use.

 

1. Definitions

1.1   In these Terms and Conditions (T&Cs), “Content” shall refer to chapters, reference book entries, articles, or whole books, or journal issues available for download or access through journals.humankinetics.com and video.humankinetics.com (Human Kinetics), or related domains controlled by the Publisher; the “Publisher” shall refer to Human Kinetics, 1607 N. Market Street, Champaign, IL 61825-5076; the term “Customer” shall refer to the individual making the online purchase of content.

2. Terms of Use

2.1   By checking the 'I agree box' and clicking the button to purchase you, the Customer, are indicating that you accept the terms and conditions set out below. Customers who do not accept these terms of use are not authorized to proceed to purchase the Content.

2.2   Customers wanting to purchase Content must first sign up for individual membership of the site (the “Account”). Customers will be prompted to do this or sign in when they start the purchase process. This personal user account is free and, in addition to allowing the purchase of Content, allows users to save Human Kinetic site search results and see lists of recently viewed or saved content.

2.3   Use of purchased Content is exclusively permitted for the Customer’s own personal purposes. 

The Customer may not:

  • save copies of the purchased Content to devices or media to which other individuals have access, including intranets or extranets or other publicly accessible networks;
  • pass on or send the Content to third parties either in electronic file format or printed format;
  • lend Content out or otherwise circulate it to others;
  • make the Content available in any other form or medium or create derivative works, in whole or in part, without the written permission of Human Kinetics;
  • reproduce or exploit the Content, in whole or in part, for commercial gain.

2.4   The Customer agrees not to share their personal Account details with third parties and to inform Publisher immediately if they gain knowledge or even a mere suspicion of any misuse. The Customer shall be liable for all consequences of third-party use of Customer’s Account insofar as they are responsible for access data being misused. This may include having to pay for any orders placed without authorization. The Customer’s liability shall only lapse when they inform the Publisher about the unauthorized usage or loss of access data and after the password has been altered if necessary.

2.5   The Publisher is licensed to use all intellectual property rights in and to this website and all technical infrastructure relating to it. The Materials are copyright © Human Kinetics or published under license from the copyright holders by Human Kinetics. The Customer undertakes to ensure that the intellectual property rights of the copyright holder and the software owners and the moral rights of the authors of the Materials are not infringed.

3. Accessing Purchased Content

3.1   After purchasing Content, Customers can download the Content in PDF format, or where PDF format is not available, the Customer can access and view or print the content in XML format through a web browser where available. To access the Content, the Customer must be logged into their personal Account. Access is limited only to Content that was purchased via single article sale or subscribed access to an individual title. The purchased Content can then be accessed directly on the Content hosting page and any PDF download by clicking the download button. The Content will continue to be available to the user and can be accessed through the Customer’s Account at a later date for at least one month after the purchase date.

4. Technical Requirements

4.1   To purchase and access Content the Customer requires standard Internet access, a standard internet browser program, and a program for viewing PDF files.

5. Cancelation

5.1   The Publisher reserves the right to not refund or cancel a Content purchase once the Content page has been accessed.

5.2   Human Kinetics reserves the right to withdraw the Customer’s access to the Content in the event of systematic breach of these conditions by any authorized user.

6. Privacy Policy

6.1   If you supply personal details to us through this website, then you consent to our maintaining, recording, holding, and using such personal data in accordance with our Privacy Policy.

7. Exclusions and Limitations of Liability

7.1   Owing to the nature of the internet, we cannot guarantee that this website or the websites to which it is linked will always be available to Customers. You should ensure that you have appropriate protection against viruses and other security arrangements in place whilst using the internet.

7.2   Although every reasonable effort has been made to ensure that the information on this website was accurate at the time of publication, it is subject to variation at any time without notice, and we do not give any warranty that any such information will be accurate or complete at any particular time or at all.

7.3   This website and any information or other material contained in it are made available strictly on the basis that you accept it on an “as is” and “as available” basis. Where you rely on any information or other material contained in it, you do so entirely at your own risk and you accept that all warranties, conditions, and undertakings, express or implied, whether by common law, statute, trade usage, course of dealings, or otherwise in respect of this website are excluded to the fullest extent permitted by law.

7.4   We exclude all liability whatever, to the fullest extent permitted by law, in respect of any loss or damage resulting or arising from any non-availability or use of this website or of any other website linked to it, or from reliance on the contents of this website or any material or content accessed through it.

8. Jurisdiction

8.1   This website has been designed and these terms of use shall be governed by and construed in accordance with the United States State of Illinois law. Any dispute arising out of the accessing or use of this website shall be subject to the jurisdiction of the State of Illinois courts in the United States.
