Reopened. The "dead architects" exception as claimed by Italian parliament pronouncement is already deprecated: see COM:FOP Italy for full information. The sculptor is not yet dead for more than 70 years as of this writing. Hallo, das Bild kommt zum Einsatz im Wikivoyage Artikel zum Ort Maratea, die Stature ist weithin sichtbar und ein Wahrzeichen des Orts. Ebenfalls im Wikipedia - Artikel zu Maratea wie auch im eigenen Artikel zum "Christus von Maratea" ist die Statue abgebildet. Ist das Euer Ernst, dass die grosse Christusstatue, die dem Ort Bekanntheit verleiht, nicht mehr in Commons abgebildet werden darf?
Zumindest müsste geklärt werden, wer Auftraggeber resp. Besitzer des Werks ist, das Städtchen oder die lokale Kirchgemeinde, die Christusstatue gehört zu einer Wallfahrtsstätte auf der Anhöhe über Maratea. Die Statue ist nicht in Privatbesitz, jederzeit frei zugänglich und wie gesagt, kilometerweit als Wahrzeichen zu sehen. LG Martin - Mboesch (talk) 18:21, 8 June 2023 (UTC)[reply]
@Mboesch: (I can only reply in English but I Google Translate-d your response). "Ownership" is not important here. Copyright here is about the protection of economic rights of one who created or designed the work. Since Italy does not allow freedom of panorama, photos of copyrighted artworks cannot be exploited for commercial purposes. The action of using commercial Creative Commons license on the photos is already a violation of Italian law. These photos must be removed until the Italian legislature becomes more forward-thinking in the rights of content creators to fully enjoy and use public art of Italy for any purposes. Hello, why do you have the idea, that CC BY-SA 4.0 is a commercial license, need the licence to be changed that this or another image can be kept. There are Wikipedia articles in several languages about this statue of the reddentore which can be seen from far and is a landmark of the whole region - if you continue with your plans to ban all images of the statue, we would need to make a remark on the Wikipedia pages, that to see something of the statue, one has to travel there. There has been a report in the web about the creation of the statue, that the sculptor was impressed by the statue of the cristo in Rio de Janeiro, so have you plans to ban that pictures from the www too. Im really motivated to spend much time to write articles even in smaller Wikimedia projects but actions like these take my motivation. regards mb - Mboesch (talk) 08:41, 22 June 2023 (UTC)[reply]
@Mboesch CC BY-SA-4.0 is commercial. The license allows the photo to be freely shared and distributed for any purposes, even commercially like in post cards and tourism souvenir items. It also allows re-users to adapt the image in many ways, even if that means gaining profit. While you may have allowed the use of commercial CC license in your photo (Commons forbids non-commercial licenses), it does not conform to the Italian copyright law regulations that do not allow free uses of architecture and public art still under copyright without licensing permissions from architects, sculptors, muralists, or their heirs if they are dead for less than 70 years.
Since 2007, Wikimedia Foundation has explicitly prohibited Wikimedia Commons from hosting non-commercial licensing and fair use content, as it is supposed to be a promoter of free culture content as defined by the Definitions of Free Cultural Works by Freedom Defined.
