David Kim and Steven Levitt authored an article for IPWatchdog, Inc that digs into the USPTO's guidance for AI systems and patentability and inventorship. "The USPTO recognizes that the guidance concerning AI-assisted inventions is an iterative process, with inventorship and determining the significance of a human contribution to an invention representing areas ripe for further clarity and refinement," the attorneys write. David and Steven say companies should update their invention disclosure protocols to encompass inquiries about the utilization of AI in the inventive process and urge practitioners to inquire about the origin, development and training processes of the AI systems. #AI #ArtificialIntelligence #AIApplications #PatentLaw

Artificial Intelligence and Patents: An International Perspective on Patenting AI-Related Inventions We at WP Thompson are proud to recognise the contributions of our Dr Julian Potter and Ranveer Riyat in the authorship of a new book titled "Artificial Intelligence and Patents: An International Perspective on Patenting AI-Related Inventions."   The book was spearheaded by John Osha in the US, who assembled patent attorneys from around the world to outline the patent landscape for AI inventions in their respective jurisdictions. Are we so sure about that? I receive multiple patents everyday that people would like us to monetize and I am always amazed by how poor the drafting quality is in many cases. Arguably, one should be able to train AI to write claims that have antecedents, proper support in the specification, are not indefinite and don't create divided infringement issues. Yet, many trained humans still commit these basic mistakes over and over and since inventors do not know about those, they are left with owning unenforceable patents that are totally worthless. So don't think a minute that AI will not be able soon to write better patents than many specialists.
