    Once again, legislation intended to help workers results in the opposite effect. Predatory individuals and law firms in California have exploited PAGA laws to target companies for quick monetary gains. How can these scams be avoided? What is PAGA? The Private Attorneys General Act (PAGA) is a California statute allowing employees to file lawsuits for labor code violations on behalf of themselves, other employees, and the state. Key points about PAGA include: 1. Purpose and Function: * PAGA allows employees to pursue claims for labor code violations, improving enforcement and compliance by enabling suits and penalty recovery. 2. Scope of Claims: * Employees can seek penalties for violations such as unpaid wages, missed breaks, and improper wage statements. Penalties are split, with 75% going to the California Labor and Workforce Development Agency (LWDA) and 25% to affected employees. 3. Process: * Before filing a PAGA lawsuit, employees must notify the employer and the LWDA of violations and allow the agency to investigate. If the LWDA does not act, the employee can proceed with the lawsuit. 4. Impact on Employers: * PAGA can lead to significant penalties and class-action-like lawsuits, making compliance with labor laws essential to avoid claims. Exploiting PAGA: Common Methods Meal Break Violations: Ensuring all employees, including temporary workers, receive timely meal breaks is critical. If an employee fails to clock in and out correctly, the host employer must correct this before the employee is paid. Some workers may intentionally not clock out, hoping the employer won’t notice. Predatory law firms actively market these opportunities, making proper meal break management essential. Mismanagement can lead to costly PAGA lawsuits. Three Important Steps: 1. Educate Operational Managers: * HR should ensure line managers understand the importance of accurate meal break tracking and adherence to the law. 2. Review Time Entries: * If using a temp agency or MSP, their management should review time entries to spot issues before payment. Both the host employer and the staffing agency are responsible for accuracy. 3. Monthly Reports: * Use a VMS to generate monthly reports highlighting clock adjustments, ensuring a record of all discrepancies. By taking these steps, companies can better manage compliance and reduce the risk of PAGA-related lawsuits.
