Setting up an IRA compliance program at your company can help manage risks as you navigate incentives under the Investment Tax Credit (ITC) and Production Tax Credit (PTC) programs. Seven weeks before construction, it is essential to focus on critical pre-construction goals that will set your clean energy project up for success and ensure you meet the requirements for Prevailing Wage and Apprenticeship and Domestic Content compliance. Prevailing Wage and Apprenticeship Compliance: • Conduct a kickoff meeting with our EPC partners. • Confirm their payroll system to ensure alignment—this initial assessment allows us to meet clients where they are but ensures they can provide us with what we need. • Verify apprenticeship capabilities early on, as state apprentice programs may require weeks or months to set up. This includes assessing if new programs are needed and determining if Good Faith efforts must be pursued. Domestic Content Compliance: • Connect with steel, iron, and manufactured product suppliers and clarify Empact's role as a 3rd-party confidential cost data repository to securely document their products' domestic content percentage. • Ensure compliance language is incorporated into contracts as soon as possible to prevent miscommunications and ensure adherence to domestic content requirements. This is important in making sure suppliers understand the information we need to verify domestic content percentage and run our calculations. These steps are essential for meeting the IRA's compliance requirements. Today, the Department of the Treasury and the IRS have released final regulations on the prevailing wage and apprenticeship (PWA) requirements for increased credit or deduction amounts for certain clean energy incentives, as outlined in the Inflation Reduction Act (IRA).
