The Federation of European Data and Marketing (FEDMA) represents the interests of the data and marketing industry from across Europe in Brussels. Its members use data for effective marketing and improved customer experience through all communications channels. FEDMA operates mainly through the participation of its network of national Data Marketing Associations (DMAs) across Europe and significant companies who have an interest in influencing legislation. FEDMA is one of the most respected advocacy organizations in Brussels. Its industry code is the only one approved and endorsed by the Article 29 working party. Its strength comes from the participation of representatives from most EU Member States, distilling views into a cohesive set of policies for the European Institutions.

For my international followers interested in #privacy and #GDPR such as members of FEDMA. The Swedish DPA Integritetsskyddsmyndigheten (IMY) issued yesterday a sanction of € 1,2 M against Avanza Bank plc for transferring particularly privacy-sensitive information to Meta (Facebook). This is said to have occurred by mistake (a so-called Meta pixel was used inappropriately). The case is almost identical to other ongoing cases and highlights the importance of properly managing settings and usage, as well as recognizing that certain tools should not be used in certain industries such as banking and finance or pharmacy/healthcare. There are also very some interesting considerations being made in the decision about what legal framework should be applied (the e-privacy directive or the GDPR). IMY shares the conclusion presented by me and SWEDMA; that the use of pixels (non-cookies) are regulated through GDPR and not by the e-privacy directive. One final observation is that the decision does not concern the use of the pixel per se but is motivated by the type of personal data that was transferred.
