Sharing the link to an article discussing Calcasieu Pass-related arbitrations, with a few comments: - The reported cases highlight the role of facilities development and commissioning provisions in LNG supply contracts. - Although these provisions are common, they are rarely comprehensive. They may lack the necessary level of detail in terms of relevant definitions, conditions precedent, restrictions, timetables and operational phases. - Disputes may arise, for example, over the scope of the seller's obligations to commission the relevant facilities before the commercial start date. - Careful drafting of these provisions in LNG SPAs (and pipeline GSAs) is key. - In some circumstances, parties may benefit from a separate commissioning agreement. https://lnkd.in/dvkn7DbN #LNG #LNGarbitration #LNGSPA

𝐔𝐧𝐢𝐩𝐞𝐫 𝐚𝐧𝐧𝐨𝐮𝐧𝐜𝐞𝐬 𝐭𝐞𝐫𝐦𝐢𝐧𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐠𝐚𝐬 𝐬𝐮𝐩𝐩𝐥𝐲 𝐜𝐨𝐧𝐭𝐫𝐚𝐜𝐭𝐬 𝐰𝐢𝐭𝐡 𝐆𝐚𝐳𝐩𝐫𝐨𝐦 𝐄𝐱𝐩𝐨𝐫𝐭 Today, Uniper decided to terminate its long-term gas supply contracts with Gazprom Export. This was made possible after an arbitration tribunal on June 7 awarded Uniper the right to terminate the contracts. Additionally, the tribunal awarded an amount of more than €13 billion in damages for the gas volumes not supplied by Gazprom Export since mid-2022. Any amounts would flow to the German federal government. 𝐌𝐢𝐜𝐡𝐚𝐞𝐥 𝐋𝐞𝐰𝐢𝐬, 𝐔𝐧𝐢𝐩𝐞𝐫 𝐂𝐄𝐎, 𝐬𝐚𝐲𝐬: “This ruling provides legal clarity for Uniper. Our termination of the contracts with Gazprom Export is the latest in a series of consistent decisions over the last three years. During this time, Uniper has written off its share in the financing of the Nordstream 2 pipeline, its stake in the Russian subsidiary Unipro and allowed its coal supply contracts with Russia to expire. Each type has distinct characteristics in terms of design, construction, and safety features. Let’s compare Type B with Type A and briefly mention the other types as well: 1. Type A Tanks: These tanks are usually spherical in shape and have a greater thickness of insulation to maintain the required low temperatures. They are widely used in LNG carriers and some land-based storage facilities. While they have a higher volume-to-surface area ratio, they require more insulation, which can impact the overall tank size and efficiency. 2. Type B Tanks: These tanks are prismatic or spherical in shape, like Type A, but they have a secondary barrier known as the “barrier system” between the inner tank and the outer hull. This barrier enhances safety by providing additional protection against leaks or breaches. Type B tanks are considered more structurally robust and offer a balance between safety and efficiency. 3. Type C Tanks: Type C tanks are generally cylindrical or bilobe in shape and have no secondary barrier. They rely on a highly insulated support system to maintain the low temperatures. While they have a simpler design and are lighter, they are typically used for smaller LNG carriers due to their limited storage capacity. 4. Independent Tanks: This category includes various tank types not covered by the above classifications, often designed for specific purposes or using different materials. Type B tanks are chosen for their safety features, making them suitable for LNG transportation in ships and other marine vessels. They strike a balance between the complex insulation of Type A tanks and the limited storage capacity of Type C tanks. The choice of tank type depends on factors like safety regulations, the intended use, and the characteristics of the LNG being transported.
