I'm guessing this will also be brought up during the FAIR Institute conference this week. This message from the SEC seems clear enough to me: " Operational disruption risks remain elevated due to the proliferation of cybersecurity attacks, firms’ dispersed operations, intense weather-related events, and geopolitical concerns. Given these risks and concerns, cybersecurity remains a perennial focus area for all registrants. The Division will focus on registrants’ policies and procedures, internal controls, oversight of third-party vendors (where applicable), governance practices, and responses to cyber-related incidents, including those related to ransomware attacks. " Watch our for those cyber-icebergs, they can ruin your day AND make sure you have documented "good faith policies and procedures" to detect cyber-risk: https://lnkd.in/e7aisX4b

The SEC's agenda in 2024 As part of Castle Hall's Due Diligence University platform, I'll be interviewing John Lukan (New York, Miami), managing director of SEC Compliance Consultants on Tuesday, November 28 at 10am Eastern. We will cover a range of compliance topics as we look to 2024: - The Private Funds rule: what are the preparation steps for managers (and investors) as we move into 2024? And what will happen with the manager pressure groups and their New Orleans lawsuit? - The new Cyber Security rule - timeline for finalisation, and potential implications for both investors and managers - The inspection agenda for 2024 - Lessons learned from recent enforcement actions - Other compliance issues I very much look forward to the conversation - registration is as below. And, next month, we will have a final 2023 session with Matthias Knab and Opalesque - this time on the proposed SEC Service Provider due diligence rule. More details to come!
