There was no word on renewing the existing Section 301 exclusions, indicating that they are set to expire on May 31. Import tarrifs are complex business and historically has been a lever that 'Government' has pulled utterly destroying vital industries in it's wake e.g. textile industry. Perhaps you know of a successful story though? None come to mind. With the end of the Solar PV panel incentive (March 2024), warehouses full of unsold panels and a now 10% price increase, this might just be the fuel to keep importers alive, rather than deduce them. So thank you ITAC, you might not be helping to reduce the costs of investing into 'green energy', but I believe that you are ensuring current wholesalers live longer. Big news from the US Department of Commerce today. Final determinations in the antidumping and countervailing (AD/CVD) investigation were issued, concluding companies in four Southeast Asian countries have been circumventing US AD/CVD duties. AD/CVD duties will be extended to solar cells and solar modules from Cambodia, Malaysia, Thailand, and Vietnam, with collection beginning in June 2024 when the Biden administration's moratorium on AD/CVD tariffs from those countries expires. The International Trade Administration Commission of South Africa (ITAC) has cited the protection of local manufactures of photovoltaic (PV) panels as the main reason for introducing an unpopular 10% tariff on solar panel imports. According to a statement by Itac on Wednesday, the application for an increase in the #customs duty on crystalline silicon PV modules was brought to Itac by ARTsolar, which, along with Seraphim Solar, are the only 2 remaining producers of PV panels in #SouthAfrica. “This is after Jinko Solar Co., Ltd., Solaire Direct, Sunpower Energy Systems (Pvt)Ltd Southern #Africa, JApowerway & SMA Inventers #Manufacturers ceased local #production & resorted to #importing the product. The major reasons for ceasing local production included high local #manufacturing costs & #competition from low-priced #imports,” said Itac. A #report by Itac investigating the #solar panel #industry found that ARTsolar had to retrench a large number of #employees in an effort to remain competitive – it shed 93% of its #workforce (from 218 to 15). One of the objectives of the 10% duty, it said, is to protect #jobs & attract #investment into the local industry. #Support for the introduction of a tariff came from the “advanced manufacturing sector desk” of the @department of #trade, industry & #competition as well as the #energy department, Seraphim & Jinko Solar. On the opposing side were Building Energy South Africa, Cyracom, Hyperion Solar #Development, Sol Invictus LLC, Rubicon #Electrical #Distributors & the South African Photovoltaic Industry Association (SAPVIA), among others. Opponents to the new tariff cited limited local capacity, the cost-raising impact of the duty, lack of #policy certainty, & a shift in focus from manufacturing to project development, #construction & #installation jobs as reasons to keep solar PV panel imports duty-free. “There are #international examples where import tariffs or local #content regulations for solar cells/modules have resulted in #job losses. Other incentives offered by #government must be explored to support local manufacturers instead of increasing customs duty,” said opponents to the tariff in Itac’s report. Itac said it is looking to introduce a temporary rebate provision on the #importation of PV panel components to mitigate instances where there are shortages of PV cells in the local market. A group of seven U.S. solar manufacturers filed antidumping and countervailing duty petitions with the U.S. International Trade Commission and the Department of Commerce, alleging unfair trade practices by producers in Cambodia, Malaysia, Thailand, and Vietnam. The petitions were filed approximately six weeks before an existing moratorium on AD/CVD duties on solar cells and modules from the same countries is set to expire. 🗓 On 17th of August, The European Commission announced that it has adopted an Implementing Regulation (“Regulation”) regarding reporting obligations and information sought from EU importers of Carbon Border Adjustment Mechanism (“CBAM”) goods, as well as the provisional methodology for calculating embedded emissions released during the production process of #CBAM. 🔸According to the Regulation, importers or customs representatives need to report on the quantity of imported goods, both direct and indirect emissions embedded in them, and the corresponding carbon price due for those emissions. This also includes carbon prices for emissions in precursor materials. This regulation applies to goods imported into the EU customs territory between October 1, 2023, and December 31, 2025. Importers are required to report (a) the quantity of imported goods in megawatt hours (for electricity) or tonnes (for other goods) and, (b) type of goods identified by their Combined Nomenclature code. 🔸For specific indirect emissions embedded in goods, reporting declarants must include (a) electricity consumption per tonne of goods produced, expressed in megawatt hours, (b) whether actual emissions are reported or default values provided by the Commission are used, (c) corresponding emissions factor for the consumed electricity, and, (d) Amount of specific embedded indirect emissions, converted into CO2e per tonne of goods, based on prescribed calculations. 🔸Member States are authorized to impose penalties if (i) the reporting declarant fails to comply with the CBAM report submission requirement or (ii) the report contains errors or omissions as per Article 13 and the reporting declarant does not take necessary corrective measures. The U.S. Department of Commerce found that the companies were moving tariff-dodging Chinese solar goods through Vietnam, Malaysia, Thailand, and Cambodia. The companies are responsible for as much as 80% of the U.S. supply of solar panels. The ruling means that these companies must pay tariffs on the circumvented goods to enter the U.S. market. The U.S. enforced anti-dumping duties on Chinese-made solar components for a decade after a Commerce investigation found Chinese companies were receiving large government subsidies that kept their prices artificially low. When prices of finished panels from Southeast Asia come in below our bill of materials cost, American manufacturers cannot compete.
