Thank you to our panel Cheryl O'Shea, Ariana Issa, James Ford and Christopher Cash for their contributions to our webinar discussing human rights investigations in complex supply chains today. 🌐 We learnt that the legislative landscape for these investigations is rapidly evolving. We're seeing a shift from the United Nations Guiding Principles s as a starting point to hard law obligations. The focus is increasingly on disclosure, mandatory due diligence, and import bans, reflecting a growing emphasis on corporate responsibility for human rights. Integration of human rights considerations into policies and systems is crucial. Companies need to embed these considerations into their supplier codes of conduct, conduct regular audits, maintain ongoing dialogue with supply chain partners, and implement robust onboarding processes to ensure supplier behaviours align with corporate values. Enhanced due diligence has become a critical tool. This involves both proactive risk mapping and reactive investigations. Cross-jurisdictional intelligence gathering is key, with a particular focus on local context and grassroots sources to truly understand the human rights landscape. An integrated approach offers significant benefits. By combining human rights considerations with traditional compliance concerns, companies can gather intelligence more efficiently, ensure consistent results, and develop a more comprehensive risk picture. This holistic view is invaluable in today's complex business environment. As new regulations like the Corporate Sustainability Due Diligence Directive (CS3D) come into play, companies must prepare by reviewing current practices and supply chains, engaging stakeholders, and ensuring robust compliance frameworks. The pace of change is rapid, and adaptability is crucial. In this evolving landscape, companies must act swiftly to adapt. External advisors can play a vital role in helping to fill information gaps and navigate these complex challenges, ensuring businesses stay ahead of regulatory requirements and ethical expectations. The Risk Advisory Group works with companies to set up policies and procedures and they can look at issues arising from an audit. They can work at a local level to bridge information gaps between the organisation and the people who are impacted by decisions. They are increasingly seeing ESG considerations come under the spotlight in wider business practices. There are benefits running an integrated compliance programme which encompasses human rights due diligence. Top tips 📌 Commit to a regular audit and compliance programme which examines the supply chain 📌 Issue a robust supplier code of conduct 📌Be prepared to adapt to new requirements 📌Any company operating in a high risk jurisdiction should have audit rights in their contracts, and these rights should be exercised. 📌Leverage existing policies and procedures 📌Break down silos #HumanRights #SupplyChain #DueDiligence #ESG
