Following a dialogue with the European Commission and the Consumer Protection Cooperation (CPC) Network, Vinted improved pricing information and transparency for consumers on its website and mobile app. The changes to the versions of Vinted's website and app that are directed to EU/EEA consumers include: - Informing consumers upfront about the total price of goods offered for sale on Vinted, including the so-called ‘buyer protection fee', which is added automatically to every purchase. - Removing misleading advertisements that create the impression that purchases on Vinted are free of charges. - Informing consumers more clearly on the process to claim a refund under Vinted's ‘buyer protection' policy if their purchase does not arrive at its destination. - More transparent and detailed information on Vinted's counterfeit review process, including the steps consumers must take to claim a refund in case their purchase turns out to be counterfeit. - More transparent and detailed information on the identity verification process that consumers must go through when they want to sell second-hand goods on Vinted, in particular, on the documents and information that they must submit. - Informing consumers more clearly about Vinted's review policy, including how average user ratings are calculated, the difference between automated reviews and user-generated reviews, as well as how users can report suspicious reviews. It's great to see the notion of digital vulnerability gaining serious attention. We've been working with this concept since (at least) 2017 in Brazil, exploring its potential practical implications. By law, all consumers are vulnerable here, but some are more - those with aggravated vulnerability. In the digital realm, the logic is pretty much the same, even if they are not consumers: all natural persons (data/AI subjects) are vulnerable, and some are more than others. The appropriated question for the digital dimension is not the “who”, but the “when” and the “why” - and what to do with these answers is a challenge to be adressed multidisciplinarily.

The Grocery Commission has launched a digital tool allowing users to anonymously report concerns or misconduct in the supermarket industry without fear of retaliation! Sounds like something from a movie but it's right here in NZ. And yes, it is necessary. 🚨 The ‘whistleblower’ tool uses the WhistleB system that incorporates data security and privacy, as well as encrypts the data and information provided. 🚨 The Grocery Commission is interested in hearing information from suppliers, major supermarkets, new and expanding retailers, or any other stakeholders, and any concerns they have about trading behaviour. 🚨The sector duopoly has been rife for decades with tales and truths of bullying behaviour and/or over-exerting their power. I worked for years in one of the duopoly and then indirectly with the other over the past 2.5 decades. I recall many decisions both incredibly positive and negative where the businesses used their strength for the better of the customer as well as their own competitive benefit. But it went both ways. Suppliers have also used their clout the manage new entrants and protect markets. It seems extreme but, remember we are a country with a population the size of Sydney. Everyone knows everyone and the wind carries voices. - Where you can hop on a plane and play the game of two degrees of separation with the person in the seat next to you and be connected within minutes. - A highly competitive industry where we would cover the "mailers" (back in the day of print) in black plastic so someone handling the print didn't see the price on bananas and tell the competition (I am still yet to meet a logistics person who received backhanders to find out the price of mince, bananas or coke yet If you know one connect me). Nice move Grocery Commission.

CUTS International Comments on Draft Guidelines on Prevention and Regulation of Dark Patterns The Ministry Of Consumer Affairs, Food And Public Distribution (MCA), Food and Public Distribution had invited comments and suggestions on the draft guidelines on Prevention and Regulation of Dark Patterns, 2023. Expresses its gratitude to MCA and has submitted its comments on has submitted its comments on proposed guidelines while also highlighting certain preliminary comments as suggestions that can be included in the guidelines. CUTS comments are attached herewith and can also be accessed here (https://lnkd.in/dTeDcB6f). Following recommendations are made: The guidelines apply to all platforms, systemically offering goods and services in the country, advertisers, and sellers as stated under guideline 3 The guidelines’ application on specific issues of dark patterns in various sectors such as e-commerce, telecom, social media platforms, fin-tech etc. need to be established and elaborated upon. For this purpose, industry specific research should be supported and subsidised by the government. Under Guideline 4 it is prohibited for any person including platforms to engage in dark patterns. The guideline is straight- jacketed and lacks a graded approach. It would be beneficial to understand the degrees of engagements and possible outcomes of the same. Voluntary disclosure on account of online platforms and users and enforceable transparency measures can keep consumers safe. Clause (vi): The definition of interface interference can include ethical designs that can improve the overall framework on dark patterns and its regulations. 5. Clause (vii): The definition of Bait and Switch as provided in the guidelines can be elaborated upon. ASCI has been addressing such issues through its existing code on misleading ads.
