If you are an employer with enterprise agreements, particularly if you also employ casual employees, then it is worth taking the time to read this recent FWC decision (link in the comments). It considers a complex question – When is a casual employee eligible to vote on a proposed EA? It is a complex question, because it turns on two things: (1) whether the employee is ‘employed at the time’ of the request to vote on the EA, and (2) whether the employee ‘will be covered’ by the proposed EA. The answers to these questions, particularly in the context of casual employment, will depend on the terms of the engagement. In this case, Southern Cross University employed casual employees for a specific period, defined by a start and end date, within which the employees were required to perform certain work for an estimated maximum number of hours. By way of example, the employees were committed to delivering tutorials over the duration of the term or session and were not free to reject the work from tutorial to tutorial. This meant that those casuals with an ‘active engagement’ at the time of the request to vote (and beyond the voting period) were eligible and entitled to vote on the proposed EA. Whilst these circumstances are relatively unique (albeit more common in the tertiary education sector), the takeaway is that careful consideration needs to be given to the precise nature of casual engagements before making a decision on the appropriate voting cohort in the lead up to a vote on a proposed EA. This is a question that all employers should consider carefully. The decision was also decided under the laws that applied prior to the ‘Secure Jobs, Better Pay’ amendments, which make some changes to the voting process (including removal of the concept of an access period) – these changes will also need to be factored into the analysis for employers who initiate bargaining on or after 6 June 2023. The decision also touches on a bunch of other issues that are often relied on by unions when attempting to challenge the approval of EAs, and that employers need to have a solid grasp of ahead of any EA vote, including: - the approach to providing access to incorporated policies and other materials; - the application of the BOOT to non-monetary conditions; - the extent to which employees starting or finishing employment during the access and voting periods should be included in the vote; and - the approach to explanation of the terms and effect of EAs (including in the context of alleged misleading statements). Surprisingly, Labor Day celebrations haven’t changed that much since 1882, when 10,000 or more New York City union members marched from lower Broadway to the Upper West Side and then partied in a nearby park for eight hours. The urge to celebrate our work and its impact may be timeless, even as the nature of work itself has changed so much over the centuries. What intrigues me most about this is how individuals and employers recognize the value of work—and how organizations and teams ensure that this value is created and sustained. Of course, there are many things that make a job fulfilling, including a fair salary, peer and manager engagement, career development opportunities and a positive culture. Every day, though, I am more convinced that there is something bigger that people seek when they want to be and do their best in their jobs. On our large team, there is a collective drive to connect to a shared purpose: to help all people have access to innovative life-saving and life-enhancing medicines. I am inspired every day by the energy and expertise—the labor—that I see, across our organization, as we work to fulfill that purpose, reimagine medicine and bring meaningful help to people in need.
