I’m so excited to share that I’ve joined Formation Advisory, founded by the incredible Verity Harding! It’s been such a privilege to have worked at techUK with so many talented policy experts across industry, government, and regulators, whose time, expertise and willingness to collaborate has made tech policy such a hopeful, thoughtful and dynamic space. I’m delighted that I’ll now be able to build on my AI expertise helping businesses tackle some of the thorniest ethical issues they face, at such an important time for global conversations on AI governance. Not to mention doing this all with Verity, who has led the conversation on AI for the past decade and foresaw many of the challenges that businesses and governments are grappling with today. ❗ Last week, 12 of the UK's regulators published strategic action plans for how they will address the development of AI technologies within their remit, including the ICO, FCA, Ofcom and the CMA. 🥇 This marks the first significant milestone since the UK Government published its pro-innovation approach to AI, and a litmus test on the extent to which the UK will be able to deliver on its promises of bolstering regulators' capabilities and enabling regulatory coordination. I read many of the plans, so you don't have to. Overall, they demonstrate the strengths of the UK's approach to AI regulation but are carried by our heavyweight digital regulators. With that in mind, the plans hint at what is at risk if the UK Government does not take seriously concerns around bolstering regulator capabilities and coordination. Read my full techUK analysis here: https://lnkd.in/e2c5pMQJ Key takeaways: 👉 In line with expectations, member regulators from the Digital Regulation Cooperation Forum (DRCF),Ofcom, Financial Conduct Authority, Information Commissioner's Office, and the Competition and Markets Authority have presented the most comprehensive plans, backed by the resources, expertise and knowledge needed to deliver on the Government’s agenda. 👉 The DRCF regulators have also showed a united front, all acknowledging and showcasing the collaborative efforts of the forum, as well as plans for joint work through initiatives such as the AI and Digital Hub, or joint statements, with the ICO and Ofcom sharing one only last week on online safety and data protection. 👉 The ICO made a statement by reaffirming that existing data protection laws and initiatives provide a sufficient framework to address privacy risks of AI technologies (without the need for additional legislation), with examples such as the Age Appropriate Design Code, and statements on emotion recognition technology. This shows the UK's front-footed and iterative approach in action, compared to the EU's more static list of categorised applications of AI by risk. 👉 Facial recognition technologies and biometrics will be an area to watch out for this year, with the ICO and Equalities & Human Rights Commission both calling it out as a focus area. 👉 Plans from the Equalities and Human Rights Commission (EHRC) and the Medicines and Healthcare Products Regulatory Agenda (MRHA) demonstrate a desperate need for additional resources to support their the day-to-day work, such as increasing their inhouse expertise and capabilities. 👉 Strategic plans were varied in depth and analysis, with some taking their own approach such as Ofgem who is consulting on AI in the energy sector before publishing a more comprehensive plan.

Navigating the UK’s Digital Regulation Landscape: Where are we headed? In partnership with techUK, the DRCF is holding a half day conference on Monday 22 April (09:00-14:00). Exhausted but so grateful to be part of this event, this team and techUK 💖 A big shoutout to all who dedicated a little of their time putting together this event. This was an absolute must-attend to everyone in the tech policy scene with a hugely successful #UKTechPlan (https://bit.ly/42jR7o8) launch where we received over 200 attendees and a 🔥agenda!! I thoroughly enjoyed Brad Smith's speech and all the conversation around AI regulation, challenges, and opportunities. It's unavoidable to talk about it, and I think rightly so, as we are unsure of what's to come and how it may affect/change the future. I would also like to say that if you ever see an event where Laura, Antony, and Neil are speaking, just go! Is it just me, or does it feel like deja vu? The DPDI No.2 Bill was introduced to Parliament today. Read techUK's summary and analysis of the new changes here, which will bring businesses more legal certainty on when they can use data to carry out research, deliver basic business services and develop technologies such as #AI 👇 ⭐ Legitimate interests: the Government has set out a non-exhaustive list of activities which may be considered a legitimate interest, including direct marketing, intra-organisational movement of data, and maintenance of security of networks and information systems. These activities will still require a balancing test. ⭐ Scientific research: in the Bill text and explanatory notes, the Government has clarified that the definition of “scientific research” in the UK GDPR includes ‘research carried out as a commercial activity’ and could include activities such as ‘innovative research into technological development.’ ⭐ Reducing compliance: to help lessen burdens for low data-intensive businesses, requirements such as risk assessments, record keeping and the need for a senior responsible individual will now only be triggered in relation to high-risk processing activities. ⭐ International transfers: organisations will not be required to apply the new data protection test set out in in the Bill if they already have existing data transfer mechanisms in place, underpinned with appropriate safeguards. Any new mechanisms from the Bill’s commencement date, will require the test. ⭐ Automated decision making: the Government will clarify that profiling is only subject to the requirements and safeguards of Article 22 when a significant decision is made without meaningful human intervention.

Digital regulation. How do we get it right? Last week techUK hosted a panel focused on the 2023 parliamentary agenda for digital regulation which aims to boost competition and innovation in the economy while making the UK the safest place to be online and manage personal data. The panel included: • Chi Onwurah, MP and Shadow Minister for Department for Business, Energy and Industrial Strategy (BEIS) • Amy J., Director of Technology Policy, Ofcom • Vincenzo Rampulla, Principal Consultant, Gemserv • Matt Peake, Global Public Policy Director, Onfido The event covered topics including the Online Safety Bill, Competition Bill, Data Protection and Digital Information Bill, and upcoming AI regulation, plus discussions on DRCF and international approaches to regulation.
