The Czech Republic has successfully defended a CZK 3.6 billion (USD 164 mil.) investment claim in WCV Capital Ventures Cyprus Limited and Channel Crossings Limited v. The Czech Republic (PCA Case No. 2016-12). The case relates to the cancellation of permits to operate video lottery terminals following decisions of the Czech Constitutional Court in 2011 and 2013. In the final award dealing mainly with the issue of liability, the Tribunal dismissed all claims on the merits. Each party bears its own costs. Our costs were about a third of those incurred by Claimants, which highlights how efficiently we conducted our defense. It’s another excellent result for our arbitration team. My appreciation particularly goes to my colleagues Lucie Ostrá and Tereza Ševčíková. We also had an excellent collaboration with the outstanding Dechert LLP team led by Eduardo Silva-Romero and Erica Stein. The victory in the WCV case follows three recent victories from 2021-2022 against Dubai-based Alcor Holdings Ltd., Dutch company Fynerdale Holdings B.V. and Swiss company Pawlowski AG, where the Czech Republic successfully defended claims totaling CZK 8 billion (USD 364 mil.). I’m glad that I had the opportunity to defend the Czech Republic in these cases.
