ASA and CAP have published their joint 2023 Annual Report. The major development, last year, was the introduction of the Active Ad Monitoring system, using AI to monitor online advertising. At the end of 2023, the new system was already processing over 500,000 ads per month. Last year, ASA and CAP secured the withdrawal or amendment of 27,387 ads, (down 12% from 2022). 89% of the withdrawn or amended ads were in non-paid media, including companies’ own websites and social media accounts. Interestingly, very few of these were a result of complaint rulings. The vast majority, 92%, resulted from proactive work, enabled by the AI assisted Ad monitoring system. It used to be thought, (rightly or wrongly), that the most likely reason for a company running into difficulties with the ASA, about an ad, was due to competitor complaints. That certainly doesn’t appear to be true anymore. CAP also delivered more than 1.3 million pieces of advice and training to businesses; in 2023, a massive one third increase from the 1M in 2022; and has undertaken projects regarding advertising and the environment, climate change, youth vaping, gambling and the advertising of prescription-only medicines. URGENT : ACTION NEEDED BY 13th AUGUST: Skills for Health have proposed some changes which could have an extreme negative impact on all of our businesses. As some of you have heard The Advertising Standards Authority tell people what they can and can't say in adverts, on their websites and, because they don't understand our industry or why Complementary Therapy doesn't test the same way as drugs do (with blind studies and placebos) this can cause big issues for us. There is a proposed change in legislation, trying to through that says we HAVE to comply with the ASA standards for advertising. This could stop us lawfully from saying that we can haven an effect on someone's health and even stop us talking about it in public forum!! ASA is a private company, not a government organisation and their primary goal is profit and they do not consult experts in the industries that they are dictating to. How can you make a difference? Fill in the form linked below: This is the proposed guidance for the answers to the questions. In response to the proposed change, we support the addition: Addition 1: Knowledge and Understanding Add requirement: The claims for your discipline that can be made in your advertising including on social media. We do not support: Addition 2: Performance Criteria Add requirement: Comply with the Advertising Standards Authority Non-Broadcast Code of Advertising and section 4 of the Cancer Act 1939 We suggest the following is more appropriate as an addition to the Performance Criteria of CNH1: Adhere to and abide by all applicable laws and regulations. For clarity the NOS should refer to the law and not to a third-party interpretation of the law. We have not been made aware of the review by Complementary and Natural Healthcare Council (CNHC) and are concerned that the appointment of one standard setting organisation amongst many in the sector does not meet the Representative Stakeholder Consultation requirements in 2.2 of Quality Criteria for development of National Occupational Standards As well as being poorly circulated the survey has no method of validating the respondents.
