The U.S. Federal Trade Commission has approved a Final Rule that essentially bans most non-compete agreements, except for those involving "senior executives" or related to the sale of a business. Companies need to understand the implications of the Final Rule on their recruitment and retention strategies, ensuring compliance and exploring alternative means to protect their business interests. Retaining top talent in an organization is a difficult task as it stands, with Final Rule it becomes even more difficult. Emphasis on career roadmaps, long term training curriculum’s, “spot bonuses”, vacation time, flexible work arrangements, daycare funding, etc. will all become that much more important to employees and candidates. Organization’s must develop strategies and invest in their employees. The regulation’s effective date is 120 days after Federal Register publication (not the public announcement).
