Sep 22, 2015 at 23:36 comment added komodosp The problem is that laws are explicit because they want people to obey the law, not because they want to punish people for not obeying them (the punishment is to deter people from breaking the law in the first place), and so cases should be judged with that in mind. Hence, people should know in advance of committing an action, whether or not they will be breaking a law and if so, not do it. If they now have to guess what jury might decide every time they wish to do something, then it would be entirely unfair.
