🚨 Key sanctions update! The UK's National Crime Agency (NCA) has taken an unprecedented step by requesting a court order to permanently seize funds held by Russian oligarch Petr Aven. The NCA claims these funds are “proceeds of crime,” alleging that Mr. Aven moved the money in violation of sanctions regulations. Stuart Hadley, an NCA spokesman, emphasised that current legislation does not permit the loss of sanctioned assets solely because the person is sanctioned; a clear link to criminal activity is required. Helen Taylor, a senior legal researcher at Spotlight on Corruption, noted that this application to Westminster Magistrates' Court sets a significant precedent. The NCA's action to move from temporary freezing to permanent seizure of these assets is the first attempt by UK authorities to track down cash suspected of having been moved in breach of Russia sanctions. The NCA applied for a forfeiture order of £1.1 million from Mr. Aven, a billionaire accused of supporting the Russian government during its war in Ukraine. The funds were frozen after the UK imposed sanctions on Mr. Aven in 2022. Mr. Aven faces sanctions not only in the UK but also in the US and the European Union. The EU Court of Justice ruled in April that there was insufficient evidence to maintain him on the sanctions list, but sanctions remain in place pending an appeal in Latvia, where Mr. Aven holds citizenship. The NCA investigated Mr. Aven’s business and real estate interests in the UK. In May 2022, the NCA successfully froze £1.5 million, suspecting that transactions involving Mr. Aven's representative breached UK sanctions regulations or aimed to circumvent them. If the NCA convinces the court to permanently seize £1.1 million, it underscores the seriousness of sanctions violations and reinforces the message that such actions will face consequences. We are excited to share that Team Fieldfisher has played a pivotal role in Norway's most ambitious space endeavour to date – the USD 450 million Arctic Broadband Satellite Mission (ASBM). Space Norway is soon set to launch two state-of-the-art ASBM satellites from Vandenberg Space Force Base in California on a SpaceX Falcon 9 rocket. These satellites will revolutionise communication by delivering the world's first dedicated broadband services to the Arctic region, an area previously with limited coverage. We are glad to publish the first of three articles in a mini-series co-authored by Fieldfisher LLP and Egemenoğlu. The series will explore the fundamentals of Turkish and UK employment law which are necessary for compliance with local requirements. This article is intended to assist an employer proposing to hire employees in either or both of the UK and Türkiye. It provides a brief overview of the main employment law considerations when drafting employment terms in each of these jurisdictions. We would like to thank specifically Moira Campbell and Mehmet Baysan from Fieldfisher who has given a diligent effort to put this idea into an action and to create such an important guideline for the practitioners.
