    @Aaron But Van der Lans holds, in line with precedent, that doing all their good maintenance and due diligence is not by itself sufficient. In Van der Lans, a part failed before its average life span was reached. The court said that even if the failure could not reasonably have been foreseen, the event could not constitute "extraordinary circumstances."

    Wouldn't "something technical is in a questionable condition, until found either working fine or not working fine" be more or less EQUAL to defective when it comes to aircraft maintenance? Commented Sep 18, 2019 at 22:25
