#Trust is a fundamental human need and forms the essential basis for successful interpersonal interactions. How important is #institutionaltrust then? In his latest article for Trusts & Trustees Executive Chairman H.S.H. Michael von Liechtenstein discusses the interdependence of trust in state institutions and a country's #economicsuccess and sets the context for the foundation and trust business. In doing so, he refers to a study which was conducted by the Stiftung für Staatsrecht und Ordnungspolitik in 2019: "Institutional trust as a success factor." The study examined the importance of institutional trust as a key factor of a country's success and came to the following conclusions (among others): 👉 the closer politics and state institutions are to the people, and the greater the understanding of democratic processes is in society, the more positive is the assessment of political players and state institutions 👉 mutual institutional trust, for example between citizens and the administration, lowers compliance costs, reduces the need for monitoring by the authorities, and eases the bureaucratic efforts of citizens and companies when implementing political regulatory objectives 👉 conversely, a vicious circle arises when mistrust on one side leads to mistrust on the other, for example when a state imposes increasing regulations and documentation requirements on its citizens, thereby complicating public affairs ❗️ To read the whole article click on the link in the comments, it will take you to the corresponding website of Trusts & Trustees. What would happen if courts and their representatives would become lobbyists? In his latest article (in German) for the Swiss economic newspaper Finanz und Wirtschaft News our executive chairman Michael von Liechtenstein explores this question. The independence of courts and their representatives is a key element of a functioning rule of law. Judiciary must take place within an ordinary legal framework and be based on an emancipated decision-making. Recognizing the separation of powers means that case law must adhere to this. Nonetheless, it is evident that courts are repeatedly challenged in this respect by the attempts to instrumentalise them for politically motivated manoeuvres. The danger exists that courts undermine existing law with their decisions and create new, "judge-made" law, while at the same time jeopardizing their own credibility by deviating from their actual claim to independence. There are recent examples that illustrate this. Particularly, international courts and their representatives can of course make independent judgements, but they may not challenge national legal systems and handle unilaterally decisions as compelling fundamental decisions for all. Rather, they can dismiss a claim on the basis of inadequate facts and pass the ball back to the right players. In her speech at this year's Wealth Solutions Forum in #Singapore, H.S.H. Princess Gisela Liechtenstein (Bergmann) addressed the significance of private wealth 👉 not only for a family but also for a society as a whole. She illustrated how long-term wealth preservation can be achieved, for example through the use of foundations and trusts. Thereby, a holistic view of a wealth situation and the timely involvement of future generations are key aspects of this.  This year's Wealth Solutions Forum in Singapore was attended by over 260 wealth professionals. More than 25 speakers delved into various topics around the challenges and expectations of entrepreneurs and families, such as: asset protection, business families in transition, the role of HNW insurance, wealth structuring trends, philanthropy, global diversification and regulatory changes, as well as key considerations HNWIs should have in mind when contemplating their wealth preservation and transfer strategies, and how to involve the next generations.
