  • Why does commercial or not matter? I thought it only mattered: (1) for copyright, when dealing with a licence that only allows noncommercial use (2) for personality rights. Neither of these is likely to apply here, based on the question. Commented Apr 1, 2021 at 5:33

    @BrianDrake The first factor in a fair use consideration is the purpose and character of the use which explicitly includes whether it's a commercial nature. And beyond that it's a consideration in damage calculations and the like. Commented Apr 1, 2021 at 12:04
