This publication signifies the culmination of extensive efforts and collaboration across various stakeholders to establish a robust regulatory framework for artificial intelligence. 🚀 𝗧𝗵𝗲 𝗥𝗼𝗮𝗱𝘄𝗮𝘆 𝘁𝗼 𝗣𝘂𝗯𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻 The journey to the publication of the EU AI Act has been marked by rigorous discussions, negotiations, and shared vision among EU member states: · April 2021: The European Commission proposed the AI Act. · June 2022: The European Parliament adopted its position on the AI Act. · March 2023: The EU Consilium reached a common position. · June 2024: The final green light was given by the Council of the European Union. · 12th July 2024: The Act was published in the OJEC. 🔍 𝗡𝗲𝘅𝘁 𝗦𝘁𝗲𝗽𝘀 𝗮𝗻𝗱 𝗜𝗺𝗽𝗹𝗲𝗺𝗲𝗻𝘁𝗮𝘁𝗶𝗼𝗻 𝗧𝗶𝗺𝗲𝗹𝗶𝗻𝗲 With the publication now official, the following steps are crucial: · 1st August 2024: The Act will come into effect, initiating the process of compliance and integration. · Q3 2024 - Q1 2025: EU member states will begin incorporating the Act’s provisions into their national legal frameworks, establishing regulatory bodies and educating stakeholders. · Q2 2025: Organizations will need to start conducting comprehensive audits of their AI systems. · Q3 2025: Implementation of necessary adjustments to align with the new regulations should be underway. · Q4 2025: Full compliance with the Act's requirements is expected. 🏦 𝗥𝗲𝗹𝗲𝘃𝗮𝗻𝗰𝗲 𝗳𝗼𝗿 x-markets consulting At x-markets, we understand the significant impact this regulatory framework will have on the financial markets. Social und Governance Aspekte haben für die BaFin aktuell noch eine nachrangige Priorität. ☣️𝗜𝗻𝘁𝗲𝗴𝗿𝗮𝘁𝗶𝗼𝗻 𝘃𝗼𝗻 𝗘𝗦𝗚-𝗥𝗶𝘀𝗶𝗸𝗲𝗻 𝘂𝗻𝗱 𝗸𝗹𝗮𝘀𝘀𝗶𝘀𝗰𝗵𝗲𝗻 𝗥𝗶𝘀𝗶𝗸𝗲𝗻: Das Verständnis und die Steuerung des Zusammenspiels von ESG-Risiken und klassischen Risiken ist entscheidend. 🗄️𝗥𝗲𝗹𝗲𝘃𝗮𝗻𝘇 𝗱𝗲𝘀 𝗥𝗶𝘀𝗶𝗸𝗼𝗶𝗻𝘃𝗲𝗻𝘁𝗮𝗿𝘀: Genaue Dokumentation und Bestandsaufnahme der ESG-Auswirkungen auf Geschäftsmodelle wird erforderlich. 👍🏻𝗘𝗻𝘁𝘄𝗶𝗰𝗸𝗹𝘂𝗻𝗴 𝘃𝗼𝗻 𝗕𝗲𝘀𝘁 𝗣𝗿𝗮𝗰𝘁𝗶𝗰𝗲𝘀: Die Etablierung von Benchmarks für die Quantifizierung von ESG-Risiken wird angestrebt. 🏦𝗔𝘂𝘀𝘄𝗶𝗿𝗸𝘂𝗻𝗴𝗲𝗻 𝗮𝘂𝗳 𝗱𝗮𝘀 𝗞𝗿𝗲𝗱𝗶𝘁𝗿𝗶𝘀𝗶𝗸𝗼: ESG-Risiken können bspw. die Renditekurve und das Risiko von Kreditspreads massiv beeinflussen. 📐𝗛𝗲𝗿𝗮𝘂𝘀𝗳𝗼𝗿𝗱𝗲𝗿𝘂𝗻𝗴𝗲𝗻 𝗯𝗲𝗶 𝗱𝗲𝗿 𝗥𝗶𝘀𝗶𝗸𝗼𝗺𝗲𝘀𝘀𝘂𝗻𝗴: Traditionelle Value-at-Risk (VaR)-Modelle sind aufgrund unzureichender historischer Daten über Klimaschäden (noch) nicht praktikabel. 🔀𝗦𝘇𝗲𝗻𝗮𝗿𝗶𝗼𝗮𝗻𝗮𝗹𝘆𝘀𝗲: Einsatz von What-if-Ansätzen wie Sensitivitäts- und Stresstests erscheinen erforderlich, bis umfassendere Daten verfügbar sind. 🔬𝗤𝘂𝗮𝗹𝗶𝘁𝗮𝘁𝗶𝘃𝗲 𝗠𝗼𝗱𝗲𝗹𝗹𝗲: Nutzung qualitativer Modelle in Ermangelung geeigneter quantitativer Modelle angebracht. 🐾𝗕𝗶𝗼𝗱𝗶𝘃𝗲𝗿𝘀𝗶𝘁ä𝘁 𝗮𝗹𝘀 𝗮𝘂𝗳𝗸𝗼𝗺𝗺𝗲𝗻𝗱𝗲 𝗥𝗶𝘀𝗶𝗸𝗼-𝗗𝗶𝗺𝗲𝗻𝘀𝗶𝗼𝗻: Schutz der Biodiversität wird als nächster wichtiger Schwerpunkt erachtet. 🤝𝗘𝗨 𝘂𝗻𝗱 𝗻𝗮𝘁𝗶𝗼𝗻𝗮𝗹𝗲 𝗕𝗲𝗵ö𝗿𝗱𝗲𝗻 𝗴𝗲𝗯𝗲𝗻 𝘀𝗶𝗰𝗵 𝗮𝗯𝗴𝗲𝘀𝘁𝗶𝗺𝗺𝘁: Zeitliche als auch inhaltliche Umsetzung der Aufsichtspraxis soll einheitlich ablaufen. Fazit: Die BaFin unterstreicht die Bedeutung von ESG-Faktoren bei der Finanzaufsicht und forciert den Wandel hin zu einer nachhaltigen Finanzwirtschaft. Gerade die Verankerung von ESG-Risiken in der #MaRisk zeigt die Bedeutung, die dem ESG-Risikomanagement beigemessen wird. So ist das Verständnis von ESG-Risiken innerhalb des MaRisk-Rahmens entscheidend für die künftige #Compliance und das strategische #Risikomanagement in Finanzinstituten.
