From Cart to Claim: Addressing Product Liability in Online Marketplaces

The pandemic-accelerated surge in online shopping has made online marketplaces indispensable for connecting consumers with diverse products, but it also raises concerns about consumer protection if they encounter defective and dangerous items. Despite these challenges, many marketplaces have proactively implemented consumer protection measures, and U.S. marketplaces prioritize consumer satisfaction and excel in complaint resolution and ratings compared to lower-rated Chinese counterparts. The report recommends that Congress establish a national strict liability standard, state lawmakers tailor liability rules for different marketplaces, and that regulators develop voluntary best practices for buyer protection and expand data-sharing between retailers and government agencies.
