Unless User:Xles is Natalie McCray, this is a direct copy of a work that does not have a specific license grant, and does not seem to meet the non-originality criterion. This is a shame, because it's a good image; if Natalie McCray could be persuaded to contribute her design, that would be the best outcome. The Anome (talk) 03:42, 26 December 2019 (UTC)[reply]

Delete: no. This is Wikimedia Commons. Many files have been uploaded to this site without a license grant. This file was uploaded over 4-1/2 years ago. Commons:Threshold of originality. Pyxis Solitary (talk) 12:57, 26 December 2019 (UTC)[reply]
You're missing my point, which is that Wikimedia Commons should not be a dumping ground for tracings of other people's artwork. The submitter is clearly very unlikely to be the original artist, making their "own work" license grant invalid, and the shape of the lips arguably has a creative component.

In any case: I've now re-artworked the image from the known-free kiss-less version and File:Emojione 1F48B.svg, which is CC 4.0. The resulting work should now be Commons-compatible. Perhaps the earlier non-license-compliant versions of this could now be suppressed, in which case we would now have a license-compliant version of this flag, and this RfD could be closed? -- The Anome (talk) 13:22, 27 December 2019 (UTC)[reply]

  • Question - is there an assumption of copyright if none is specified? I do not see any claims on the linked source nor the apparel site which appears to have been abandoned got the last 5 years. EvergreenFir (talk) 03:06, 9 January 2020 (UTC)[reply]
Yes; the Berne Convention which virtually all the world has signed says that copyright is automatic without any requirements for notice.--Prosfilaes (talk) 11:06, 11 February 2020 (UTC)[reply]
  • Nomination withdrawn, per my comments above, and replacement of original image by license-compliant image consisting of combination of non-copyrightable stripes design with license-compliant lips image. -- The Anome (talk) 11:16, 13 January 2020 (UTC)[reply]

Kept: per discussion. --Krd 17:31, 23 March 2020 (UTC)[reply]
