Two weeks ago, the European Council approved the Artificial Intelligence Act (AIA), set to take effect in stages commencing in two years. This is the first regulation of its kind, defining clear boundaries and comprehensive rules, aiming for safe and trustworthy AI systems across Europe. What does this mean for our business in Switzerland? AI technologies are becoming more and more relevant in our field of expertise. That is why we will conduct a conformity assessment and implement any necessary changes before this new regulation takes full effect. You might also want to have a look at it. Penalties for non-compliance under the AIA can reach up to 7% of the annual turnover or 35 million EUR, whichever is higher. Like the GDPR, the AIA has an extraterritorial effect. If you develop or professionally use AI software that affects people in the EU, it likely applies to you. Exceptions exist for scientific research, military, and defense purposes. It provides rules for AI systems following a risk-based approach: . Unacceptable risk: Total prohibition · High risk: Strict requirements and assessments · Limited risk: Transparency rules · Low risk: No formal requirements The obligations under the AIA also depend on the role, including provider, deployer, importer, or distributor of an AI system. The AIA broadly defines an “AI system” as a machine-based system designed to operate autonomously and adaptively, generating outputs such as predictions, content, recommendations, or decisions. Examples include chatbots, virtual assistants, writing assistants, automated internal controls, predictive analytics and forecasting, natural language processing applications, robotic process automation, and general-purpose AI models. Swiss FTS Glossary | Data Reduction: Narrowing a larger data set to a smaller data set for the purposes of review, based on a mix of objective and subjective criteria. Data reduction methods include: • Removal of immaterial items (e.g. empty files, folders, or other containers) • Removal of known files (either using public lists such as NIST or project specific exclusion lists) • Deduplication of exact or near duplicates • Pre-filtering the data on key terms, custodians, file types, or date ranges Data reduction requires carefully balancing the reductions of the quantity of documents to review, increasing the relevancy ratio of reviewed documents, and avoiding filtering out important documents.
