    #SundayofLeaders Have you ever faced a battle so fierce that it transformed you into a warrior of the mind? As you know, continuous learning is one of my favorite topics! Last year, I was delving into the mysteries of the mind with a Neuroscience diploma. Last Friday, I conquered the legal battlefield with my LLM - a Master 2 in Intellectual Property Law and Management - the MIPLM from the Center for International Intellectual Property Studies - CEIPI and from the University of Strasbourg! It has been an epic journey filled with incredible allies, friends, and adventurers, guided by brilliant teachers – true wizards in management and law! We faced numerous obstacles, always guided by these wise souls. Months ago, I faced one of my darkest moments – surgery and chemotherapy. Rising like a phoenix from the ashes, I emerged victorious! Even before finishing my treatment, I embarked on a new quest called MIPLM! I met wonderful people, brilliant minds, and passionate professionals. What a journey! Last Friday marked our final battle - an oral exam! For this occasion, I transformed my hotel room into a war room. Take a look at the pictures! This LLM journey has been transformative. I’ve practiced IP for over a decade, especially IP Strategy, thanks to my mentor Nicolas Hautier from HAUTIER IP, whose MBA provided a business vision of IP. I inherited this approach from him and Jean-Pascal DECOBERT. I've practiced with know-how but without the real theories behind it, I am now armed with both knowledge and theory, making me more powerful than ever! Special thanks to Prof. Dr. Alexander J. Wurzer and Thibaud Lelong, whose passions for IP Law and Management have been incredibly inspiring. Alex is a role model and mentor for me and probably for a lot of my IP co-warriors! And here I am, on a train back from Strasbourg with my LLM in my pocket, new knowledge in my mind, and an unquenchable passion in my heart! Now, I will hone my skills even further because when you blend know-how with theory, you optimize and amplify your impact! To all my connections, this journey is a testament to resilience, continuous learning, and the power of mentorship. Each obstacle is an opportunity to grow.     How to distill a machine learning model. (Not for drinking. But for patenting…) A) Have you devised a new type of neural network, a new method for training it, or new applications for such networks? B) Would you like to patent your idea? If your answers to A) and B) are yes, chat with your patent attorney: they’re friendly, and it’s fun talking to them. They’ll check if the idea might be patentable. In short, to be patentable (under European practice), the idea must be new and inventive, and the inventive part must be technical. (Yes, dear colleagues, I know this is a simplified version of the truth.) There are some further requirements, though, which become more and more apparent as the case law evolves. The recent decision T 1425/21 of the Boards of Appeal of the European Patent Office nicely illustrates some of them. The decision is about a patent application filed by Google, with the catchy title “TRAINING DISTILLED MACHINE LEARNING MODELS.” The patent application at question described a scheme for training a “distilled” model to match the output of a conventional “cumbersome” model. The distilled model has fewer parameters, thereby reducing its memory footprint. A good idea, but the patent application was rejected. Here are two important reasons for that: 1) The Board was not convinced that the distilled model would work as well as the cumbersome one, nor that it would represent a “good” trade-off between resource requirements and accuracy because the patent application lacked information in this regard. 2) The patent application did not describe the architecture of the distilled model. There are many ways to reduce the number of parameters (e.g., by reducing the number of neurons, or of levels, or of weights), but the Board doubted that they all would lead to a useful result. Nor did the patent application describe certain other aspects that made their way into the final claim. Hence, the Board concluded that the application failed to sufficiently teach how to implement the claimed invention. What do we learn from this? 🧠 In AI-related patent applications, make sure to not only describe general principles but also provide examples of specific architectures, training procedures, etc. A well-drafted patent application will not be restricted to these particular examples, but without them, the patent office may find that the application fails to provide sufficient teaching. 🧠 In AI-related applications, it can be helpful to include evidence showing that the claimed invention actually works (such as data comparing the invention’s performance to prior-art solutions). And note: this information should be part of the patent application as filed. Adding it later is tricky at best. #patent #ai
