𝗪𝗮𝗴𝗲 𝗧𝗵𝗲𝗳𝘁 𝗥𝘂𝗹𝗶𝗻𝗴 𝗜 𝗠𝘂𝗹𝘁𝗶-𝗺𝗶𝗹𝗹𝗶𝗼𝗻 𝗗𝗼𝗹𝗹𝗮𝗿 𝗣𝗮𝘆𝗯𝗮𝗰𝗸 Australia’s largest car dealership, Eagers Automotive Limited (EAL), is required to back pay more than $16 million, including interest and superannuation, to underpaid staff. The business self-reported the underpayments to the Fair Work regulator. Consequently, EAL entered into an Enforceable Undertaking (EU) with the regulator to reimburse the impacted employees. 𝗧𝗿𝗮𝗻𝘀𝗳𝗲𝗿 𝗼𝗳 𝗟𝗶𝗮𝗯𝗶𝗹𝗶𝘁𝘆 𝗱𝘂𝗿𝗶𝗻𝗴 𝗮𝗰𝗾𝘂𝗶𝘀𝗶𝘁𝗶𝗼𝗻 Significantly, this underpayment related to employees who were employed by Automotive Holdings Group Limited (AHG). EAL purchased AHG in 2019. After the purchase, EAL investigated and identified the underpayments that had occurred with the previous employer. Given that EAL had purchased AHG, this liability was then legally transferred to EAL. 𝗪𝗮𝗴𝗲 𝗧𝗵𝗲𝗳𝘁 𝗶𝗻 𝘁𝗵𝗲 𝗦𝗽𝗼𝘁𝗹𝗶𝗴𝗵𝘁 This case highlights the ongoing vigilance that Australian businesses need to exercise in ensuring that employees are being remunerated correctly. Changes to the Fair Work Act, expected in the next year, will make intentional underpayment of wages by employers a criminal offence (the Victorian Government, who currently have similar laws in place, have announced plans to repeal them pending the application of the new Federal laws).
